HGV PCV TRAINING LTD
1. What we require from the trainee driver
(1A) The trainee driver will always provide the correct and full information to HGV PCV Training LTD.
(1B) Whilst taking the course, the trainee driver will always, be expected to have the necessary legal driving documents in their possession.
(1C) The trainee driver will show the DSA examiner and the theory test centre a form of photographic ID, their current driving licence with current address, the correct entitlement and when needed a valid theory test pass certificate. All documentation needs to be present on the days of the theory or practical driving test.
(1D) If at any time the trainee driver is considered to be under the influence of alcohol or illegal drugs by HGV PCV Training LTD or it’s accredited training partners, the course will immediately be terminated, and the fees will be forfeited.
(1E) It is the responsibility of the trainee driver to ensure that the correct provisional entitlement has been added to his/her driving licence by the DVLA. A trainee driver without the correct entitlement will not be allowed to train and all monies paid towards course fees will be forfeited.
(1F) Whilst the trainee is attending any course with HGV PCV Training LTD or their training partners, the trainee is expected to conduct themselves in an appropriate manner. HGV PCV Training LTD reserve the right to terminate a course in a reasonable discretion without any warning, should them feel that a trainee has acted or behaved inappropriately, including; but not limited to verbal and physical abuse towards HGV PCV Training LTD staff, training partner staff or DSA staff. If the trainee wished to appeal this decision they should contact the operations manager HGV PCV Training LTD, at email@example.com.
2. Training with HGV PCV Training LTD
(2A) The minimum course length of a C or C+E course will be 16 hours including the time whilst on test, which could run between 3 – 6 days. A training day can start from different times throughout the day, with the trainee driver spending between 3 – 8 hours at the driving wheel. Training may be carried out on a 1-1 or 2-1 basis depending on the training location. In the event of the training vehicle breaking down HGV PCV Training LTD will arrange for the trainee driver to have further training to make up for lost time, at a time that is convenient for the trainee driver at no extra cost. If the course is cancelled due to instructor illness HGV PCV Training LTD will re book the course for an alternative date convenient for the trainee driver and at no extra cost. If the trainee fails to complete or attend the course for whatever reason including but not limited to certified sickness, then all course fees will be forfeited. the trainee driver will accept that the LGV instructor believes that the trainee is not fit to take his/her LGV practical test for any reasons of safety the trainee driver will be informed, and the test will be rescheduled at the trainee drivers’ expense. Any complaints about the LGV course should be directed to firstname.lastname@example.org with your booking reference number. HGV PCV Training LTD will endeavour to reply within 21 working days all course dates, test dates and retest dates will be confirmed in writing via email unless post is requested by HGV PCV Training LTD. If no written confirmation is received, then contact HGV PCV Training LTD on 0800 292 2723. Without written confirmation of your course you have no proof of booking.
3. Payment Terms
(3A) Course fees include, Medical examination, Username and Password to login and study for your theory test, Theory test, course registration, DVLA medical licence and the practical driving lessons.
(3B) Course fees vary therefore trainee drivers should contact HGV PCV Training LTD directly for details of current course fees.
(3C) Course fees must be paid in full 21 days prior to the booking of the C or C+E course unless a finance loan has been arranged via HGV PCV Training LTD. If a finance loan is used, then all repayments must be met unless the booking is cancelled in accordance with the Cancellation and Refund Policy section below and any cancellation or other fee is settled in accordance with the cancellations when paying by Finance Loan section below.
(3D) Course prices and any additional charges will be agreed in writing upon booking.
(3E) Retests are not included in the training package unless confirmed in writing with HGV PCV TRAINING.
4. Cancellation and Refund Policy
Please also refer to Cancellations when paying by FINANCE LOAN where a FINANCE LOAN has been taken out.
(4A) If the trainee driver cancels the booking within 14 days of paying, then monies paid will be refunded in full, if paid by debit or credit card. If the trainee driver has taken out a finance loan, then the agreement will be cancelled, and no money will leave the trainee’s account. This is in accordance with the distance selling regulations, 2000. If a trainee driver has had their course booked and confirmed in writing, no refund is available. If you have paid by finance loan and your course had been booked and confirmed, then you will still have to pay back the finance, even if you do not attend. Cancellations must be made in writing via email to email@example.com or by phone call on 0800 292 2723. If the trainee driver cancels after 14 days but the course has not yet been booked and confirmed in writing, then they will incur a 40% cancellation fee of the total course value, plus any cost incurred.
(4B) The terms (course bookings) ’booking’ applies to trainee drivers that have made a full or part payment on any course sold by HGV PCV Training LTD.
(4D) Any refund approved will be returned to the trainee driver within 14 working within receipt of the request, if payment was made by debit/credit card.
(4E) Refunds are subject to the following cancellations fees based upon the timescales below; (these are in place as HGV PCV Training LTD make block bookings for trainee drivers considerably in advance of the course dates). Cancellation requests 14 days or less after booking; no cancellation fee. Cancellation fee requests after 14 days; a cancellation fee of 40% course fees, together with any other fees will apply.
(4F) If genuine medical preclude the driver from attending the course, then if possible (and on the production of proof) HGV PCV Training LTD will endeavour to book the trainee driver on other course dates if possible. This change of dates will incur booking fees.
(4G) If a trainee driver purchased a back to back course consisting of category C and C+E licence course then the following terms apply; Any cancellations of any element of the back to back course is subject to the terms of points (4D & 4E) above. If the trainee has attended C portion of their course, then any cancellation of the C+E course is subject to the same point of (4D & 4E) above. Cancellation timescale in this instance will start from the trainee driver requests cancellation of the C+E course. The remaining course will be subject to a 40% cancellation fee.
(4H) If a trainee driver has purchased a HGV PCV Training LTD Course then the following terms apply; Trainee drivers are booked on courses and places reserved far in advance. Once a trainee driver has received written confirmation of their HGV PCV Training LTD course dates, these cannot be changed without incurring a fee.
(4I) Medicals – if the trainee driver fails their DVLA medical, and copies of the DVLA written confirmation or failure is received by HGV PCV Training LTD from the DVLA then all course fees paid by the trainee driver are refundable. Important medical note; it is the DVLA not the examining doctor who decides the outcome of a medical examination. The trainee driver must return the completed D4 form to the DVLA, where their medical examiners will review the submission and decide on whether to grant a provisional licence. Correspondence from the DVLA can be accepted for a refund based on medical grounds.
5. Cancellations when Paying by Finance Loan
(5A) When a booking is cancelled in accordance with the Cancellation and Refund Policy section, within 14 days, then no money will leave the trainee’s account. When a booking is cancelled in accordance with the Cancellation and Refund Policy section, after 14 days the balance of the finance loan will need to be settled. The balance of the finance loan in this instance will be any cancellation fee, together with any other fees, less the loan repayments already made by the trainee. If the loan repayments exceed the cancellation fee and any other fees, then the excess will be refunded to the trainee.
7. Confidentiality and data protection
(7A) HGV PCV Training LTD will keep confidential any information which the trainee drivers supply to HGV PCV Training Ltd in connection with this agreement, with the expectation of basic personal details which may be shared with partner schools and potential employers as part of the placement service provided by HGV PCV Training LTD.
(7B) Services provided by HGV PCV Training LTD are also administered by HGV PCV Training LTD. This primary aim of this website is to provide you (consumer) with information about what to do at HGV PCV Training LTD and how we can assist you in your career. We want you to feel secure when visiting our site and are committed to maintaining your privacy when doing so. The following provides an overview of how we protect your privacy during your visit
(7C) Sharing with third parties; we will not share any of the gathered information with any people or organisation outside of HGV PCV Training LTD. Sensitive personal data; we do not generally seek to collect sensitive personal data through this site. If we do not seek to collect, we will ask to consent to our proposed uses of the data we may also collect some sensitive personal data incidentally. By providing us with unsolicited sensitive personal data, you consent to our using the data subject to applicable law as described in this privacy statement. The reference 2 ‘sensitive personal data’ are to the various categories of personal data identified by European and other data privacy laws as requiring special treatment, including in some circumstances the need to obtain explicit consent. These categories comprise personal identity numbers, personal data about personality and private life, racial and ethnic origin, nationality, political opinions, membership of political parties or movements, religious, philosophical or other similar beliefs, membership of a trade union or profession or trade association, physical or mental health, genetic code, addictions, sexual orientation, property matters or criminal record (including information of suspected criminal activities).
